1. The Verification and Special Projects Committee
has the primary role of verifying incident reports
provided by the monitoring teams. This is in
addition to any other Special Projects that they
may be allocated by the Senior Envoys’ committee
or the JSC Committee. In order to establish how
the Verification Committee should conduct its
function, this paper makes some recommendations
for the JSC to consider. The Verification
Committee should use these recommendations as the
basis for their discussion prior to final approval
by the JSC Committee. |

Komite Verifikasi dan Proyek Khusus mempunyai
peranan penting dalam memverifikasi laporan
insiden yang diberikan oleh tim monitoring. Hal
ini merupakan tambahan terhadap setiap Proyek
Khusus lainnya yang dialokasikan oleh Komite
Utusan Senior atau Komite KKB. Untuk menentukan
bagaimana Komite Verifikasi menjalankan fungsinya,

2. The aim of the Verification Committee is to
provide Investigation Team for the JSC to
investigate and evaluate and also to find out the
causes of the incidents as required. |
|

team investigasi bagi KKB untuk menginvestigasi,
dan mengevaluasi serta menyelidiki sebab akibat
terjadinya kasus-kasus sebagaimana diminta. |

3. The Verification Committee has two main
functions: |

4. The Verification Committee has a number of
resources that it can use to conduct its
functions. These include: |

5. The procedure that the Verification Committee
will follow is linked to the sanctions paper
currently under discussion in the JSC. In outline
this involves the following three stage process: |
|

5.1. Stage One. Initial investigation by TMT
leading to a report with evidence and the causes
of a serious violation. Information Management
Committee assesses the report and decides whether
the incident is a serious violation and if the
evidence is sufficient to proceed further. |

mendapatkan laporan tentang bukti dan sebab akibat
dari suatu pelanggaran serius.Komite Manajemen

5.2. Stage Two. If the incident is considered a
serious violation, the Information Management
Committee tasks the JSC Verification Committee to
conduct a second investigation and assessment.
This may entail deployment of the Verification
Committee or one of its teams to the location of
the incident or simply a more thorough analysis of
the TMT evidence. The Verification Committee will
weigh up the evidence and decide whether the
incident is a violation. If on the balance of
evidence the Verification Committee is convinced
that the incident is a violation the case should
be passed to the JSC Senior Envoy Committee. |

pelanggaran serius, Komite Manajemen Informasi
menugaskan Komite Verifikasi KKB untuk melakukan
investigasi dan penilaian kedua. Hal ini mungkin

5.3. Stage Three. The JSC Senior Envoy and Senior
Representative Committee will then deliberate over
the case and award a sanction if appropriate. |

kemudian akan merundingkan kasus tersebut dan akan
memberikan sanksi jika diperlukan. |

6. The Verification Committee must therefore
decide, when handed an incident report by the
Information Management Committee how they wish to
conduct their investigation. If they wish to
conduct the investigation themselves or task one
of the Verification Teams they must inform the
Operations Committee so that the resources can be
tasked to assist them. |
|
|
|
Komite Verifikasi selanjutnya memutuskan ketika
diserahkan laporan insiden oleh Komite Manajemen
Informasi dan bagaimana keinginan mereka untuk
melakukan investigasi. Jika mereka ingin
melaksanakan investigasi sendiri atau menugaskan
salah satu Tim Verifikasi, mereka harus

7. The
Verification Committee must then assess the causes and
evidence available to them. When considering the
evidence presented they must make an objective
judgment as to whether, on the balance of evidence,
the incident was a violation of the COHA and if one,
both or neither party were accountable for the
incident. |

akibat dan bukti yang ada. Ketika mempertimbangkan
bukti yang ada, harus membuat keputusan yang
objektif , berdasarkan bukti, apakah insiden

8. When deliberating over each incident the
International member of the Verification Committee
is to act as Chairman. In all cases the
International is to attempt to gain a consensus of
opinion on the evidence. This may not always be
possible. Therefore there are three possible
outcomes and procedures: |

sebagai ketua. Dalam setiap kasus anggota
internasional mencoba untuk mendapatkan

8.1. Consensus Violation. In the event of a
consensus opinion that a violation was committed
by one or both parties, the Verification Committee
must then decide on the level of the violation and
the appropriate sanction. The committee should
then pass the case file with their recommendation
to the Senior Envoy and Senior Representatives
Committee for their decision. The verdict will be
published by the JSC through the PIU. |

|
Kesepakatan Pelanggaran. Jika tercapai kesepakatan
bahwa pelanggaran dilakukan oleh salah satu pihak
atau kedua pihak, Komite Verifikasi kemudian
memutuskan tingkat pelanggaran dan sanksi yang
pantas. Kemudian menyerahkan arsip kasus tersebut,
dengan rekomendasi, kepada Komite Utusan Senior
dan Perwakilan Senior untuk diambil keputusan.
Putusan akan dipublikasikan oleh KKB melalui UIP. |

8.2. Hung Opinion. In the event of a hung opinion
with one party against the violation or two
parties against the violation, the case file is to
be passed to the Senior Envoy Committee. The file
should include the opinions of all members of the
committee. The Senior Envoy Committee will then
deliberate over the case. |

|
|
Penggantugan Opini. Jika dalam keadaan
penggantungan Opini oleh salah satu pihak atau dua
belah pihak yang menentang pelanggaran, arsip
kasus diserahkan kepada Komite Utusan Senior.
Arsip tersebut memuat opini-opini dari seluruh
anggota komite. Komite Utusan Senior kemudian akan
merundingkannya. |

8.3. Consensus Non-Violation. In the event of a
consensus that an incident was not a violation the
case is closed and the verdict passed to the
Information Management Committee. The JSC will
publish the verdict through the PIU. |
|
|
|
Kesepakatan Non-Pelanggaran. Jika terjadi
kesepakatan bahwa insiden tersebut bukan merupakan
pelanggaran maka kasus ditutup dan putusan
diserahkan pada Komite Informasi Manajemen. KKB
akan mempublikasikan putusan tersebut melalui UIP. |

9. Depending on the security situation there may be
a significant number of cases which the
Verification Committee will have to consider. The
cases will have to be prioritised to ensure that
the most important cases are considered. When
considering cases the Verification Team should
attempt to gain a consensus of opinion on the
incident to limit the number of cases that the
Senior Envoy and Senior Representative Committee
has to consider. |

Tergantung pada situasi keamanannya, mungkin ada
sejumlah kasus yang signifikan yang harus
