1. In the interest of the security and law
order in the waters of Nanggroe Aceh Darussalam
Province, the Regional Martial Law Administrator
of Nanggroe Aceh Darussalam according to article
25 paragraph (7) in connection with article 26
paragraph (1) in connection with article 49 Act
number 23 The Banning of Foreign Vessel/Boat
Traffic and Foreign Vessels/Boat Activities in the
Indonesian Waters in the Nanggroe Aceh Darussalam
territorial waters as follow:
a. "Vessels/Boats" in this decree means all
transportation vehicle and or vehicles for other
activities operated above or under water, which
can float and or dive and self-propelled or
assisted by other power.
b. "Foreign vessel/boat" in this decree
means all vessels/boats which are not operated by
enterprises or individuals that comply with
Indonesian Law.
c. "Waters" in this decree means internal
waters and Indonesian territorial sea in the
territorial waters of the Nanggroe Aceh Darussalam
Province for the operational strategic interest of
the Regional Martial Law Administrator of Nanggroe
Aceh Darussalam Province, abridged as PDMD Prov
NAD, which is 12 miles in breadth as regulated in
the Act Number 6 Year 1996 on Indonesian Waters.
Beyond 12 nautical miles shall comply with the Act
Number 17 Year 1985 on the Ratification of UNCLOS
1982.
d. For the security and the law order in
the territorial waters of the NAD Province, PDMD
Prov NAD closes temporarily the waters as
mentioned in point 1 c above from all vessel/boat
traffics and the activities of foreign flagged
vessels/boats.
e. Al foreign flagged vessels/boats or
foreign fishermen will be banned from conducting
fishing activities and other activities in the
waters mentioned in point 1 c, including all
foreign flagged vessels/boats and foreign
fishermen that previous permit from the
authorities for such activities.
2. Any one who deliberately violate the
provisions of this decree despite having been
sufficiently warned will have to face firm
measures as follows:
a. Warning using radio, light, flag and sound.
b. Eviction by driving out of the waters as
referred to in point 1c in this decree
c. A sinking measure by a canon fire or other
weapons or other kind of explosives if the
measures in point 2a and 2b can not be carried
out.
3. This decree shall enter into force upon
the date of its promulgation.
