PRESIDENTIAL DECREE OF THE REPUBLIC OF INDONESIAN THE CAPACITY OF
CENTRAL MILITARY EMERGENCY ADMINISTRATOR
NUMBER 43, 2003

ON

CONTROL OF THE ACTIVITIES OF FOREIGN CITIZENS, NON-GOVERNMENTAL ORGANIZATIONS AND JOURNALISTS IN THE PROVINCE OF ACEH

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering:

That for public safety, in the interests of public order and in the interests of security as long as the Military State of Emergency in Aceh Province continues it is considered that it is necessary to issue this Presidential Decree in the capacity of Central Military Emergency Administrator regarding control of the activities of foreign citizens, non-governmental organizations and journalists in the Province of Aceh;

Recalling:

1. Article 4(1), Article 10 and Article 12 of the 1945 Constitution as amended by the Fourth Amendment to the 1945 Constitution; Act Number 23 PRP/1959 regarding State of Emergency (State Paper of the Republic of Indonesia 1959, No. 139, Additional State Paper No. 1908) as amended twice, most recently by Act No. 52 PRP/1960 (State Paper of the Republic of Indonesia 1960, No. 170, Additional State Paper No. 2113); Presidential Decree No. 28, 2003 regarding the Declaration of the State of Emergency with the Military State of Emergency Phase in the Province of Aceh (State Paper of the Republic of Indonesia 2003, No. 54);

RESOLVES:

To establish:


The Presidential Decree in the capacity of Central Military Emergency Administrator regarding control of the activities of foreign citizens, non-governmental organizations and journalists in the Province of Aceh.

Article 1

1. As long as the Military State of Emergency continues in Aceh Province, foreign citizens are forbidden from tourist visits and may not carry out activities that are incompatible with the implementation of the objectives of the Military State of Emergency in Aceh Province.

To support the success of the integrated operation in the framework of the implementation of the Military State of Emergency in Aceh Province, visits and activities by foreign citizens can be carried out with the permission of the Indonesian Minister of Justice and Human Rights in the name of the President as the Central Military Emergency Administrator.

Foreign citizens who are bound to implement work contracts as well as agreements with the Government of the Republic of Indonesia that have already commenced are to report their existence and the implementation of their activities in Aceh Province to the Regional Military Emergency Administrator.

Article 2

2. Non-governmental organizations, whether foreign or Indonesian are forbidden from carrying out activities activities that are incompatible with the implementation of the objectives of the Military State of Emergency in Aceh Province.

Humanitarian aid that comes from friendly countries, world bodies and non-governmental organizations, whether foreign or national in Aceh Province will be coordinated by the State Coordinating Minister for Public Welfare in the name of the President as the Central Military Emergency Administrator.

The implementation of humanitarian aid as intended in subsection (2) will be brought into line with the humanitarian operation that is being carried out by the Regional Military Emergency Administrator.

Article 3

1. Journalism activities that are carried out by foreign journalists and correspondents for foreign media in Aceh Province can be done in a selective way after receiving permission from the Foreign Minister in the name of the President as the Central Military Emergency Administrator.

Journalism activities that are carried out by national journalists for national media in Aceh Province can occur after receiving written permission from the Regional Military Emergency Administrator.

All risks and consequences that arise from journalism activities carried out by either foreign or national journalists in Aceh Province are the responsibility of those involved.

Article 4

This Presidential Decree takes effect on the date it is issued. In order to make it known to the public, it is ordered that this Presidential Decree be placed in the State Gazette of the Republic of Indonesia.
